Effective Date: October 25, 2026
Last Updated: October 25, 2026
These Terms of Service ("Terms") are an agreement between you and Elijah Loving, doing business as WellHouse ("WellHouse," "we," "us," or "our"). They are the main terms for everything WellHouse runs, including:
PLEASE READ SECTION 14 CAREFULLY. IT REQUIRES MOST DISPUTES TO BE RESOLVED BY INDIVIDUAL ARBITRATION INSTEAD OF IN COURT, AND IT WAIVES THE RIGHT TO BRING OR JOIN A CLASS ACTION. YOU CAN OPT OUT OF ARBITRATION WITHIN 30 DAYS AS EXPLAINED IN SECTION 14.
In short: by using any WellHouse site or service, you agree to these Terms and our Privacy Policy.
1.1 Agreement. By visiting our sites, sending a form, creating an account, joining a class or community, or clicking a button such as "I agree," "Sign," or "Subscribe," you agree to these Terms and to the WellHouse Privacy Policy at https://wellhouse.app/privacy, which is part of these Terms.
1.2 App and service terms. Some Services have their own extra terms (Section 9). If those extra terms conflict with these Terms, the extra terms control for that Service.
1.3 Project agreements control project work. Commissioned work is covered by its own signed agreement, such as an Illustration Agreement, its Creative Brief, and any signed addendums (a "Project Agreement"). If a signed Project Agreement conflicts with these Terms, the Project Agreement controls for that project.
1.4 Using the Services for an organization. If you use the Services for a business, school, club, or other organization, you confirm you have authority to accept these Terms for it, and "you" includes that organization.
1.5 Electronic records. These Terms, notices, receipts, and other records we provide electronically meet any requirement that they be in writing, under the federal E-SIGN Act and the Iowa Uniform Electronic Transactions Act. You may ask for a copy at info@elijahloving.com.
In short: most Services are for adults. Minors can take part only in specific cases, with written permission from a parent or guardian, and never under 13.
2.1 Adults. You must be at least 18 (or the age of majority where you live) to hire WellHouse, sign a Project Agreement, use the Client Portal, or buy a subscription.
2.2 Minors. Our classes and community spaces are adult-first (18+). A person aged 13 to 17 may take part only with written permission from a parent or legal guardian, who agrees to these Terms for them and is responsible for their participation and any purchases. If a project is for a minor (for example, a young author), a parent or guardian must be the client and must sign.
2.3 Never under 13. The Services are not directed to children under 13, and we do not knowingly allow anyone under 13 to use them or knowingly collect their personal information. If we learn that we have, we will delete it. Some apps set a higher minimum age in their own terms.
2.4 Sanctions and export. You confirm that you are not located in a country under a U.S. Government embargo and are not on any U.S. Government list of prohibited or restricted parties.
2.5 Your account. Keep your login details and private links secure. You are responsible for activity under your account. Tell us right away at info@elijahloving.com if you think someone has used your account without permission.
In short: our sites show Elijah's work and let you reach us. Using a form does not create a contract.
3.1 Information only. Content on wellhouse.app and elijahloving.com, including blog posts and videos, is for general information. Older blog posts may be out of date.
3.2 Contact and intake forms. Sending a contact or project form does not create a contract or reserve any dates. Work starts only under a signed Project Agreement.
3.3 Links to other sites. Our sites link to other services, such as Patreon, YouTube, Instagram, Facebook, TikTok, X, Twitch, and Discord. We do not control those sites, and their own terms and privacy policies apply.
In short: every illustration is drawn by hand. We do not use your content to train AI.
4.1 Hand-made. WellHouse illustration is drawn by hand by Elijah Loving. No AI image generation is used at any stage of commissioned work.
4.2 No AI training. We do not use your content, your files, or the artwork made for you to train artificial intelligence or machine learning models, and we do not allow our service providers to do so. Some apps may offer optional AI tools, such as IGNITE's AI-assisted briefs. Those tools never make your art, and their app terms explain how they work.
In short: what you share with us stays yours. You give us only the permission we need to provide the Services.
5.1 You own Your Content. "Your Content" means anything you send or upload, such as form answers, manuscripts, references, sketches, logos, notes, messages, and files. You keep all ownership rights in it.
5.2 Permission you give us. You give WellHouse a non-exclusive, royalty-free license to host, store, copy, display, and use Your Content only as needed to provide the Services you asked for, to perform any Project Agreement, and to comply with law.
5.3 Your responsibilities. You confirm that you have the rights to share Your Content and to ask us to use it, including any third-party characters, brands, logos, or photos.
5.4 Feedback. If you send us ideas about the Services, we may use them without any obligation to you.
In short: you pay the prices shown or agreed in writing. Project fees and deposits follow your Project Agreement.
6.1 Project fees and deposits. Fees for commissioned work are priced per project or per item and set in your Project Agreement, including any deposit and payment schedule. Invoices and deposits are paid through Square. Cancellation fees, refunds, and late payments follow your Project Agreement.
6.2 Subscriptions. Some apps and memberships are paid subscriptions that renew automatically until you cancel. The price, billing period, renewal terms, and how to cancel are shown before you buy and are set out in that app's or membership's terms.
6.3 Patreon. Patreon memberships are billed by Patreon under Patreon's terms. Manage or cancel them in your Patreon account.
6.4 Payment providers. Payments are processed by providers such as Square, Patreon, Apple, Google, or a third-party payment processor that we will name before the app launches. WellHouse does not receive or store your full card number.
6.5 Taxes. Prices may not include sales tax or similar taxes, which will be added where required.
In short: be respectful. Classes may be recorded. Your clips are posted only with your consent.
7.1 Community standards. In our Discord server, Patreon, livestreams, and other community spaces, you agree to be respectful, and not to harass, threaten, or discriminate against anyone, post hateful, sexually explicit, or graphic content outside clearly marked age-restricted spaces, share anyone's private information, spam, or impersonate anyone. Discord's and Patreon's own rules also apply.
7.2 Age-restricted material. Adult material, such as figure study, is shared only in age-restricted spaces that members under 18 cannot access.
7.3 Recordings. Live classes, critiques, and streams may be recorded so members can watch them later. We will tell you when a session is being recorded. If you do not want to appear, you may keep your camera and microphone off and use text chat.
7.4 Student work and clips. We post clips, critiques, or artwork from students publicly only with that student's consent, and for students under 18 only with a parent or guardian's written consent. You may withdraw consent for future posts at any time by emailing info@elijahloving.com, and we will remove posts we control where reasonably possible.
7.5 Your work stays yours. Artwork you share in class remains yours.
7.6 Moderation. We may remove content or members who break these Terms or community rules, and where the law requires or safety demands, report it to the authorities.
In short: the Portal is where clients review briefs, sign agreements, and pay. Your e-signature counts like a handwritten one.
8.1 Access. The Client Portal at portal.wellhouse.app is by invitation for WellHouse clients. Clients do not pay to use the Portal itself.
8.2 Electronic signatures. When you sign in the Portal, your electronic signature has the same legal effect as a handwritten signature under the E-SIGN Act and the Iowa Uniform Electronic Transactions Act. Before you sign your first document, the Portal asks you to agree to do business electronically. You may ask for a copy, or withdraw that consent for future documents, by emailing info@elijahloving.com.
8.3 Signature records. To keep a reliable record, the Portal records your name, email address, the date and time, and technical information such as your IP address and device or browser details with each signature and approval.
8.4 Countersignature. A Project Agreement or addendum becomes binding only after both you and the Artist have signed it. The Portal then creates a locked PDF copy for both of us.
8.5 Service emails. While you have an active project, the Portal sends automatic emails about documents, signatures, payments, and timeline updates.
8.6 Full Portal terms. Detailed WellHouse Client Portal terms will be posted before the Portal opens to clients and will add to these Terms.
In short: each WellHouse app will have its own short terms for features unique to it, posted before that app launches. These Terms still apply.
If you get an app from the Apple App Store or Google Play, that app's terms include the additional terms Apple and Google require.
10.1 You agree not to: use the Services to break the law; upload content you do not have the right to share; upload malware or try to access other people's accounts or data; get around security or access controls; copy, resell, or reverse engineer our software; or sign documents in someone else's name.
10.2 Copyright complaints (DMCA). If you believe content on our Services infringes your copyright, send a notice to our copyright agent that includes your signature, the work, where the material is, your contact details, a good-faith statement that the use is not authorized, and a statement under penalty of perjury that your notice is accurate and you are the owner or authorized to act for the owner. Copyright Agent: Elijah Loving, info@elijahloving.com. Notices must be sent by email. We may terminate accounts of repeat infringers.
The Services, including the software, designs, templates, text, artwork, and the WellHouse and Elijah Loving names and logos, belong to WellHouse or its licensors. Rights in commissioned artwork, including portfolio use, are set only by your Project Agreement. You may not copy or reuse our artwork or templates without written permission.
12.1 TO THE FULLEST EXTENT ALLOWED BY LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT PROMISE THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE. Please keep your own copies of important files and signed documents. Nothing here reduces any promise made in a Project Agreement.
12.2 TO THE FULLEST EXTENT ALLOWED BY LAW, WELLHOUSE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS OR DATA. OUR TOTAL LIABILITY FOR ALL CLAIMS ABOUT THE SERVICES WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). Liability for project work is set by your Project Agreement. These limits do not apply where the law does not allow them.
12.3 Indemnity. To the extent allowed by law, you agree to cover WellHouse's reasonable costs, including attorneys' fees, from claims caused by Your Content or your violation of these Terms or the law.
These Terms are governed by the laws of the State of Iowa and U.S. federal law. The Federal Arbitration Act governs Section 14. Any claim not subject to arbitration will be brought only in the state courts located in Decatur County, Iowa, or the United States District Court for the Southern District of Iowa, unless the law of the place where you live gives you the right to sue there.
In short: let's try to fix problems informally first. If that does not work, disputes go to individual arbitration, not court, and no class actions. Small claims court is still available, and you can opt out within 30 days.
14.1 Informal resolution first. Before filing a claim, send a written notice to info@elijahloving.com describing the dispute and what you want. If it is not resolved within 60 days, either of us may start arbitration or a small-claims case.
14.2 Agreement to arbitrate. Arbitration is the primary way disputes are resolved. Except as stated in Sections 14.3 and 14.6, any dispute arising out of or relating to these Terms or the Services will be resolved by final and binding individual arbitration instead of in court. Disputes about project work follow the arbitration clause in your Project Agreement, which uses the same approach.
14.3 Exceptions. Either of us may bring an individual claim in small claims court, and either of us may go to court to stop misuse of intellectual property or confidential information.
14.4 Rules. Arbitration will be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules then in effect (or its Commercial Arbitration Rules for business customers). Hearings will be held by video, phone, or written submissions unless the arbitrator decides an in-person hearing is needed, in which case it will be held in Decatur County, Iowa. Fees follow AAA's rules.
14.5 Class action and jury waiver. YOU AND WELLHOUSE MAY BRING CLAIMS AGAINST EACH OTHER ONLY INDIVIDUALLY, NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS OR REPRESENTATIVE PROCEEDING. YOU AND WELLHOUSE BOTH WAIVE THE RIGHT TO A JURY TRIAL.
14.6 Opt out. You may opt out of arbitration by emailing info@elijahloving.com within 30 days after you first accept these Terms, with your name, email, and a clear statement that you want to opt out.
14.7 Changes. A material change to this Section will not apply to a dispute you told us about before the change.
15.1 Changes. We may update these Terms. We will post the new version here and change the "Last Updated" date, and for material changes we will give at least 30 days' notice. Changes never alter a signed Project Agreement.
15.2 Termination. You may stop using the Services at any time. We may suspend or end access if you seriously break these Terms or the law. Ending access does not cancel a signed Project Agreement.
15.3 State rights. Nothing in these Terms takes away rights that the law says cannot be waived. California users: you may contact the Complaint Assistance Unit of the California Department of Consumer Affairs at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or (800) 952-5210.
